Today, in Broome County Court, Luis Benitez-Vega (23 years old), was acquitted of the charges Criminal Sexual Act in the Third Degree (Class E Felony) and Criminal Obstruction of Breathing or Blood Circulation (Class A Misdemeanor). Mr. Benitez-Vega had previously waived his right to proceed with a jury trial and, instead, elected to proceed with a bench trial (trial by judge). The bench trial began on December 10, 2010, and ended today. The trial was held before the Honorable Martin E. Smith, Broome County Court. After considering the case, Judge Smith acquitted Mr. Benitez-Vega of both charges contained in the indictment.
It was alleged that on or about January 26, 2013, in the City of Binghamton, that Mr. Benitez-Vega engaged in anal sexual intercourse with a woman without her consent. It was further alleged that on or about January 27, 2013, in the City of Binghamton, that Mr. Benitez-Vega intentionally impeded the normal breathing or circulation of blood of a woman by applying pressure to her throat or neck. After finding Mr. Benitez-Vega “Not Guilty” of both charges, Judge Smith directed his release from the Broome County Jail.
